Alabama law allows for filing of divorce under both fault and no-fault grounds. The ground for a no-fault divorce in Alabama is irretrievable breakdown of the marriage. Fault grounds include adultery, desertion, imprisonment in a penitentiary for periods as determined by statute, addiction to alcohol or drugs after the marriage, mental incapacity for periods as determined by statute, cruelty, and other statutory grounds as outlined in the Code of Alabama, Section 30-2-1.
